Abstract:
This study addresses one of the most significant jurisprudential maxims recognized by scholars: the principle that “avoiding scholarly disagreement is recommended,” as upheld by the Ḥanbalī school. Given the frequency with which this maxim appears in Ḥanbalī legal texts—particularly within the chapters on acts of worship—the study explores how the school’s jurists have articulated this principle, the conditions and parameters that govern its application, and presents applied examples from various jurisprudential issues within the domain of worship.
